Umer Asad, Advocate High Court of GHB&C Advocates, issues this public notice on behalf of his client Mrs. Zaitoon Ghulam Hussain, resident of Flat B-3, Mumtaz Square, Ch. Khaliq Uz Zaman Road, Clifton, Karachi. Mrs. Hussain is the sole lawful owner of Flat No. B-3 (Ground Floor, Block‑C, 1,451 Sq. Ft.) with 1/5th share of Sub‑Plot No. 3, Plot No. 7, Sheet No. FT‑3, Frere Town, Karachi (Sale Deed No. 2045 dated 22.10.1995).
On 12.04.2026 Mrs. Hussain agreed to sell the property to Mr. Mumtaz Ali S/O Ghazi Khan (resident of Flat A‑6, Hamilton Court, G‑2/1, Clifton, Karachi) through estate agent Mr. Syed Danish Ali S/O Syed Waris. Despite the expiry of the stipulated deadline of 11 July 2026, repeated reminders, and a legal notice dated 14.09.2026, the purchaser failed to pay the balance or complete the transaction. The agreement dated 12.04.2026 is declared automatically cancelled.
Consequences stated by the issuer:
- The earnest money (Bayana) of Rs. 5,000,000/- shall stand forfeited to the client.
- Mrs. Zaitoon Ghulam Hussain is discharged and indemnified from all present and future liability regarding the property and is free to sell or otherwise deal with it as she deems fit.
- The client will pursue all civil and criminal remedies against the purchaser and the estate agent at their cost.
The general public is cautioned against dealing in the property with anyone other than Mrs. Zaitoon Ghulam Hussain; any such dealing will be at the dealing party's own risk.
