Auction Terms and Conditions
The properties will be sold through open public auction on an “as is, where is” basis. The auction proceedings will take place according to the schedule above.
If bidding does not occur at the reserve price, the reserve price may be reduced by 10% after one month. The successful purchaser must deposit Rs. 100,000 as earnest money before making an offer and pay 20% of the purchase price immediately after acceptance of the bid during the auction proceedings. The balance is payable within 15 days from the auction date in favour of the decree holder and must be credited through the Court Auctioneer.
The Court Auctioneer may accept payment by cash, pay order or cross cheque drawn in favour of the decree holder. The auction may be adjourned where necessary, subject to directions of the Court. The Court may extend the time for payment upon the purchaser furnishing acceptable guarantees.
The plaintiffs and judgment debtor may participate personally or through duly authorized representatives. The plaintiffs may bid without depositing earnest money and may adjust the bid amount against their outstanding claim, subject to the Court’s directions. A successful plaintiff purchaser must furnish a bank guarantee for 20% of the purchase price, valid for at least two months.
The highest bid remains subject to confirmation by the Court. Acceptance of a bid does not itself confer ownership. If an application concerning acceptance or rejection of the highest bid is pending, the Court Auctioneer will seek appropriate directions.
Failure to pay the balance within 15 days, or within an extended period allowed by the Court, may result in forfeiture of the deposit and resale of the property. A defaulting purchaser may also be liable for any deficiency arising from resale and related expenses.
The purchaser is responsible for applicable taxes, stamp duty, transfer expenses and other charges levied by the relevant federal or provincial authorities. The auction is subject to the provisions of Order XXI of the Code of Civil Procedure, 1908, and the Court’s directions.
