Auction and Payment Conditions
The auction will be conducted through open public bidding. Cantonment Board Kohat will retain the call deposit receipts of the first- and second-highest bidders. The highest bidder's Rs. 1,000,000 call deposit will be retained upon approval of the bid and converted into the Cantonment Fund as advance rent. The remaining amount will be collected monthly in advance after the grace period.
If the highest bidder fails to deposit the Rs. 7,680,000 refundable security within seven days of approval, the Rs. 1,000,000 call deposit will be forfeited. The second-highest bidder will then be offered the highest bid amount, subject to depositing the Rs. 7,680,000 refundable security within seven days of issuance of the offer letter. The second-highest bidder's retained Rs. 1,000,000 call deposit will be deposited in the Cantonment Fund as advance rent if the offer is accepted.
Conditions imposed from time to time by the Government, Military Lands and Cantonments Department, or any other relevant government department concerning the site's use and petrol pump operations will be binding on the tenant.
The successful bidder must construct the petrol pump at their own cost according to an approved building plan and applicable regulations, including public washrooms and ATM and POS machines. Any additional requirements or restrictions imposed by Cantonment Board Kohat concerning the site's use during the tenancy must be met. The Board will not charge a building plan fee, but will grant administrative approval.
A nine-month grace period from the handing over or occupation of the site will be allowed for construction and establishment of the petrol pump and allied infrastructure. Monthly rent becomes payable from the last day of the tenth month of occupancy or taking over the site, the monthly rent falling due, or payment at approved rates, whichever occurs earlier.
The prospective highest bidder must remove the existing Cantonment Board shops and offices at their own risk and cost. Cantonment Board Kohat will assist the highest bidder or tenant with this process.
The relevant tenancy will continue for more than ten years or a similar term. Mandatory feasibility studies, including a market survey or analysis and assessment of market rent, must be completed before tenancy renewal for each tenure, to determine an additional 25% initial refundable security based on the rent prevailing after every ten years.
The annual increase in rent will be at least 10%, or up to a reasonable amount to adjust the prevailing inflation rate.
Tenancy, Transfer and Renewal
Subletting is subject to Cantonment Board approval and payment of the fee decided by the Board. The agreement between the tenant and subtenant must conform to the main agreement between the Board and tenant.
Transfer of tenancy rights is subject to payment of the transfer fee decided by the Board. A similar security amount to that held for the outgoing tenant must also be obtained.
A new tenancy agreement must be executed with the incoming tenant for the residual tenancy period.
The existing tenant will have the right of refusal upon completion of the first and second tenancy terms. Tenancy rights will be re-auctioned if the existing tenant refuses an extension.
The petrol pump, together with allied facilities, will become Cantonment Board Kohat property after expiry of the tenancy period.
The successful bidder must arrange utilities, including electricity, water and other allied services, at their own expense.
The premises may be used only for purposes expressly permitted by the Cantonment Board. A violation will lead to cancellation of tenancy rights.
Compliance and Operating Responsibilities
The auction notice is also available on the PPRA website at www.ppra.org.pk.
All taxes, utility bills, repairs, maintenance and other charges, including licence and conservancy charges, must be borne by the tenant.
The successful bidder must obtain all required no-objection certificates for establishment of the petrol pump from the concerned departments at their own expense.
If required, the successful bidder must install an electric transformer or solar system after obtaining an NOC from Cantonment Board Kohat.
Monthly rent must be deposited in the Cantonment Fund account on or before the tenth day of each month. Late payment will attract a fine at 1‰ of the monthly rent.
If rent remains unpaid for three consecutive months, the agreement will be cancelled and the structure or building, together with the entire call deposit and security amount, will be forfeited by Cantonment Board Kohat.
The tenancy agreement must be registered with the Sub-Registrar under the Registration Act, 1908, at the tenant's cost.
After expiry of the tenancy period, refundable security will be returned following adjustment of the tenant's liabilities, if any, at the time of vacation. The Board or committee will establish these liabilities, and all dues must be cleared before refund.
Tenancy rights will be re-auctioned after expiry of the tenancy period.
If a dispute arises with Cantonment Board Kohat, the contractor must refer the matter for arbitration to the Director Military Lands and Cantonments, Peshawar Region, Peshawar. The arbitrator's decision will be binding and cannot be contested in a court of law.
The Cantonment Board Kohat or Cantonment Executive Officer reserves the right to accept or reject any bid without assigning a reason, in accordance with PPRA Rules.
Detailed terms and conditions may be obtained from the Cantonment Board office during working hours on any working day.
Legal and Regulatory Requirements
The tenant must comply with local building codes, zoning laws and environmental regulations; obtain necessary permits and approvals from relevant authorities; and protect intellectual property rights associated with the design.
Prospective bidders must certify that they have not been blacklisted, declared defaulters, or debarred by any government or semi-government department in Pakistan. An undertaking to this effect must be submitted on Rs. 1,200 stamp paper to Cantonment Board Kohat.
Any dispute with the Board must be referred by the contractor to the Director Military Lands and Cantonments, Peshawar Region, Peshawar, for arbitration. The decision will be binding and cannot be contested in a court of law.
The open public auction will be held in accordance with PPRA Rules. The Board or CEO reserves the right to cancel any or all bids under Rule 33 of the PPRA Rules, 2004.
To ensure successful execution of the project, only firms with extensive experience in running petrol pumps and financial soundness will be allowed to participate.
A requisite experience certificate covering at least ten years and a financial bank statement must be submitted to the tendering bidders or Cantonment Board Kohat for issuance of permission to participate in the bid.
If the site is vacated by the Board for its own requirements or legal complications at a subsequent stage, Cantonment Board Kohat will pay compensation equivalent to the value of construction or provision of the building plan to the tenant.
Evaluation and Monitoring
The project will be regularly monitored and evaluated to ensure adherence to the agreed timeline and quality standards. Tenant performance will be reviewed to assess compliance with the tenancy agreement.
